SUCCESSFUL APPEAL – CLIENT CHARGED WITH POSSESSING PROHIBITED DRUG

Our client was approached by police while on board of a train. Police requested for our client to produce his valid ticket or Opal card. Our client complied and all appeared well. As police began to walk away they were altered to a cannabis-like odour originating from the area next to our client.

This led to police re-approaching our client and made enquiries as to the cause of this scent. Our client made admissions to police that he had in fact smoked cannabis prior to boarding the train.

Police escorted our client off the train and informed our client they would search him for any prohibited drugs. Our client then admitted he was in possession of cannabis. Police located a bag of Cannabis within our clients backpack.

Our client was placed under arrest and charged with:

Possess Prohibited Drug under Section 10(1) of the Drug Misuse and Trafficking Act 1985.

The Maximum penalty for this offence is imprisonment for 2 years a fine of $2200.

At this time, we were not representing our client and he received a penalty of a conviction and a fine. This was very problematic for our client as the conviction impacted his employment.

Mr Khatiz then appeared at Sydney District Court, and made powerful submissions to the Judge to reduce the penalty. The Judge was persuaded by Mr Khatiz and dismissed the conviction pursuant to a Section 10 Good Behaviour Bond.
