No Conviction – Client Charged with Assault and Damaging vehicle !

Our client and the victim were travelling in separate cars on a busy road. The victim and our client had a brief interaction while parallel to one another in traffic. Once both vehicles stopped due to the heavy traffic, our client exited their vehicle and kicked the victims vehicle. The victim exited the vehicle and our client then told them to get back in their car before hitting the victim in the chest. The victim returned to their vehicle and called the police. No Conviction - Client Charged with Assault and Damaging vehicle !

Shortly after our client was charged with the following:

  1. Intentionally or recklessly destroy/damage property contrary to Section 195(1)(a) of the Crimes Act 1900. The maximum penalty for this offence is 5 years imprisonment.
  2. Common Assault contrary to Section 61 of the Crimes Act 1900. The Maximum Penalty for this offence is 2 years imprisonment and a fine of $2200.

Mr Taleb appeared at Sutherland Local Court for the Sentence Hearing and strongly advocated for our client to not be found guilty by way of a conviction for the offences. The Magistrate was persuaded by Mr Taleb and no conviction was recorded against our client! The magistrate imposed a Conditional Release Order (Good Behaviour Bond) without conviction!
