SUCCESSFUL APPEAL – FROM JAIL SENTENCE TO GOOD BEHAVIOUR BOND

Our Client was previously convicted and sentenced to a term of imprisonment of 9 months for the offences of:

1. Acquire firearms subject to prohibition contrary to Section 74(1) of the Firearms Act 1996.
2. Use unauthorised firearm contrary to Section 7a(1) of the Firearms Act 1996.

The Maximum penalty for both offences is 5 years imprisonment.

The facts of the charges are that our client was served with a firearms prohibition order. Sometime after this order was issued, a mobile phone was seized by police which had videos depicting our client holding a firearm and firing the weapon. Upon this discovery, a search warrant was issued to our client’s address and he was arrested. Our client was then conveyed to Mt Druitt Police Station where he was charged with the above offences.

Facing a serious sentence of imprisonment our client contacted the Oxford Lawyers Parramatta Office and retained Principal Solicitor and Accredited Criminal Law Specialist Mr Zemarai Khatiz. Mr Khatiz Lodged an Appeal to reduce to severity of the original sentence that was imposed at Hornsby Local Court. Mr Khatiz appeared at Sydney District Court for the Severity Appeal and sought for the Sentence to be reduced.

The Judge allowed the appeal and varied the Sentence from imprisonment to a Community Corrections Order (Good Behaviour Bond) !
