NOT GUILTY !!!! Client Charged With Having a Brawl With Security Guards Outside The Bada Bing Strip Club at Kings Cross

On 4 November 2015, Mr Zemarai Khatiz appeared at Downing Centre Local Court for a client who had been charged with an offence of Affray. The facts of the case were that earlier this year, our client had attended the Bada Bing strip club in Kings Cross.

It was alleged by the police that our client was involved in an argument with the security guards. It was further alleged that our client punched the security guard in the face on two occasions and as a result, other security officers intervened and an alleged brawl erupted in the middle of the streets of Kings Cross. The security guard suffered injuries to his face, including a laceration to his lip.

The whole incident was captured on CCTV footage.

Mr Khatiz appeared on behalf of the client and pleaded not guilty to the charge. Mr Khatiz successfully argued that our client was acting in self-defence and that our client was assaulted by the security guard in an unprovoked attack. Mr Khatiz further successfully argued that the actions and conduct of our client was reasonable and appropriate in the circumstances. It was not excessive.

The Magistrate formed the view that the security guards had not conducted themselves in an appropriate manner and was satisfied that our client was acting in self-defence.

The Magistrate dismissed the charge.
