BAIL GRANTED!!! For a client charged with an alleged public place shooting, whilst on bail for other matters

Our Principal, Mr Zemarai Khatiz, an Accredited Specialist by the Law Society in Criminal Law appeared at Parramatta Local Court for a client, who had been alleged to have organised and lured the victim to residential area over an unsettled drug debt. It was alleged that the victim was unaware of the set up and the victim was chased by a male who fired several shots. The incident is considered very dangerous not only for the victim but for those living in the area. It was suggested by the prosecution that the likelihood of a by-stander being shot was very high. The police relied on multiple eye witnesses, CCTV footage and electronic evidence in the form of telephone intercepts. The prosecutors submitted that there was significant evidence against our client and that the case was strong! The prosecution vigorously opposed the grant of bail. It was alleged that our client had a history of previous drug matters and there was a high likelihood of a lengthy jail term if found guilty.

The offence if convicted as a maximum penalty carries a term of 20 years imprisonment.

Mr Khatiz appeared before Parramatta Local Court, where the client pleaded not guilty to the strictly indictable offence of “Discharge firearm with intent to cause grievous bodily harm”. Mr Khatiz made a Bail Application and made strong and persuasive submissions as to why bail should be granted. Mr Khatiz argued that it would take a significant period until the matter reached trial and that the case was circumstantial and defendable. He argued that the client had two children to care for and that the client had substantial family members in the community. Mr Khatiz told the magistrate that if bail was refused his client would spend about 18 months in jail waiting for the case to finish. Mr Khatiz convinced the magistrate that in all of the circumstances, bail should be granted.

Result: Bail GRANTED under strict conditions.

This is a very serious offence, and it is an excellent result considering the maximum jail sentence.
