Our client and complainant were married.
The complainant and our client were at their home when the complainant smacked their child. Our client allegedly became angry witnessing this and slapped the complainant in the face. The complainant retaliated and hit our client on the head.
Day later another argument ensued between our client and the complainant. It was alleged that our client demanded an ultimatum for the complainant to divorce him or he will kill their child. During the argument our client told the complainant to leave the house. The complainant then slapped our client on the head. It was alleged that our client then pushed the complainant’s head into the wall and began to repeatedly punch her in the arms and head. Our client was then alleged to have pulled the complainant into the bedroom and continue slapping and punching her.
Our client packed his belongings and left the home.
Later on, police arrested our client and conveyed him to Parramatta Police station where he was charged and served with an Apprehended Violence Order (AVO). An AVO relates to the protection of a person/s where a domestic relationship exists between the parties.
The AVO was imposed for a period of 2 years and the maximum penalty for breaching the conditions of the AVO are a fine of up to $5,500 or imprisonment for two years.
Our client was charged with the following:
- Two counts of Common Assault Domestic Violence Related under Section 61 of the Crimes Act 1900
The maximum penalty for this offence is 2 years imprisonment and a fine of $5500.
- Stalk or intimidate to cause fear of physical or mental harm (domestic violence offence) under the Crimes (Domestic and Personal Violence) Act 2007, Section 13(1)
