Trial Verdict - Not Guilty for Armed Robbery and all charges!Police alleged that the complainant was sitting on his balcony with friends when our client approached him. Our client sought to purchase a jacket from the complainant. The complainant allowed our client to enter his residence.

It was alleged that our client then approached the complainant with a knife and pointed it towards the complainants neck.

It was alleged that our client then raided the property and tied the complainants hands and feet together.

It was alleged then that our client stole a number of items from the complainant including their car keys, mobile phone and bank card.

It was alleged our client then entered the complainant’s motor vehicle and drove from the location.

Eventually, a neighbor cut loose the complainant and police were called.

Police charged our client with the following:

  1. Robbery armed with offensive weapon under Section 97(1) of the Crimes Act 1900.

The maximum penalty for this offence is 20  years imprisonment.

  1. Take/detain person with intent to commit serious indictable offence under Section 86(1)(a1) of the Crimes Act 1900.

The maximum penalty for this offence is 14 years imprisonment.

  1. Dishonestly obtain financial advantage by deception under Section 192E(1)(b) of the Crimes Act 1900.  

The maximum penalty for this offence is 10 years imprisonment.

  1. Take and drive conveyance without consent of owner under Section 154A(1)(a) of the Crimes Act 1900.

The maximum penalty for this offence is 5 years imprisonment.
