The complainant’s boyfriend hosted a barbecue at his residence, the complainant, our client and several other people attended the barbecue.
At about Midnight, the complainant went to sleep in her boyfriend’s bed. It is then alleged that sometime after falling asleep the complainant got woken up slightly by a light, which the complainant believes was from a mobile phone, and could feel the weight of someone sitting on the bed. The complainant didn’t turn around or say anything and fell back asleep shortly thereafter.
The complainant woke up again and could feel a hand inside her underwear on her vagina and believed it was her boyfriend. The complainant alleged that at one point once falling asleep she had felt as if there was a penis inside her vagina. The complainant was still half asleep and thought she was dreaming. She then felt the person she believed was her boyfriend start to kiss her cheek and neck. It was alleged at this point that the complainant then became a bit more awake and aware of what was happening and realised that the person didn’t feel like her boyfriend. The complainant opened her eyes, turned her head towards the person and realised that it wasn’t her boyfriend. The complainant alleged that it was our client that was in bed with her.
Shortly later our client was arrested at his home and conveyed to Blacktown police station where he was charged with the following:
- Sexual Intercourse without consent contrary to Section 61I of the Crimes Act 1900.
The Maximum Penalty for this offence is 14 years imprisonment. - Sexually touch another person without consent contrary to Section 61KC(a) of the Crimes Act 1900.
The Maximum penalty for this offence is 5 years imprisonment.
Fortunately for our client, he contacted the Oxford Lawyers Parramatta office and retained Criminal Defence Solicitor Mr Zahir Zakaria. The matter proceeded to trial.
After a lengthy trial, our client was acquitted of both charges and found Not Guilty!
