Mid-range Drink Driving– No Conviction

Mid-range Drink Driving– No Conviction

During the Christmas period, whilst double demerits were in force, our client was pulled over for a RBT along the Great Western Highway in Wentworthville.

He was on his way home from a gathering held for a friend visiting from overseas. During the course of the night he had drank four beers, two whiskeys and a small bottle of Hennessy. At the end of the night he was feeling ok to drive.

His RBT however returned a positive reading of 0.148 which is almost three times the legal limit for a full licenced driver. Consequently our client was arrested and taken to Merrylands Police Station where he was subject to further breath analysis, returning another positive reading of 0.116.

Our client, as a first time offender, was charged with mid-range PCA under section 110(4) (a) of the Road Transport Act 2013 (NSW). This charge imposes a maximum penalty of 9 months imprisonment and a $2200 fine for first offenders, along with an automatic 12 month licence disqualification.

Our client feared the consequences of conviction. He needed to travel for work and was also the sole provider for his two children and wife. His wife had a Learner Licence and his conviction would have made life very difficult for the family’s day to day needs.

Our client thought it was best to contact Oxford Lawyers, specialists in Criminal law and traffic offences. He was referred to Mr Zemarai Khatiz, Principal of Oxford Lawyers and Accredited Specialist in Criminal Law. Mr Khatiz worked tirelessly to prove that our client’s behaviour was out of character and merely a temporary lapse of judgement. The court was in agreement with the arguments presented and ordered a conditional release without conviction.

As a result of Mr Khatiz’ submissions to Parramatta Local Court, our client received an 18 month good behaviour bond without a criminal conviction, driving suspension or fine.

Our client was overjoyed with the result as he was able to retain his employment and continue to provide for his family. He was deeply in gratitude for the levels of professionalism and commitment shown by our staff in handling his matter and achieving this great result.
