No Conviction for Client Charged with Domestic Violence Related Assault

No Conviction for Client Charged with Domestic Violence Related Assault

Our client was involved in a heated argument with his wife of nearly a decade during a normal dinner at home. The situation began to rapidly escalate when threats of throwing piping hot food were made. The Police alleged that our client slapped the victim repeatedly, choked her and hit her over the head a bottle. The victim had notified a friend of what had transpired, and almost immediately arrived at their house to pick her up. Shortly thereafter she called the police to the residence.

Police soon arrived at the premises and arrested our client and conveyed him to Granville Police Station.

Our client was charged with Common Assault Domestic Violence Related under section 61 of the Crimes Act 1900 which carries a maximum penalty of 2 years imprisonment.

Our client was very distraught about the events that transpired and worried about how this offence would impact not only himself but his family and his career. Being in this situation, our client contacted Oxford Lawyers Parramatta, and was put in touch with Mr Zemarai Khatiz, Principal Defence Solicitor and Accredited Criminal Law Specialist.

Our client showed contrition for his actions and apologised to his wife. Mr Khatiz conveyed the depth of our client’s remorse to the magistrate at Fairfield local court and submitted how our client had made changes to his life in order to repair the damage done to his family. On reviewing the submissions made by Mr Khatiz and the steps our client had taken to better himself, the magistrate agreed with Mr Khatiz that our client was sorry and despite the serious nature of his charges and did not record a conviction.

This outcome was deeply appreciated by our client. Because of the work from Oxford Lawyers and Mr Khatiz our client was able to stay out of jail with no conviction and focus on rebuilding his relationship with his family.
