BAIL GRANTED – CHARGED WITH POSSESSING DRUGS AND PROHIBITED FIREARM

The Following was alleged by the police:

The police executed a search warrant on our client’s residence. The police investigation was in relation to an alleged theft of an unreturned hire vehicle which was parked in the secured basement of our client’s residence.

Police observed our client in the basement car park approaching and unlocking the hired vehicle. Our client was approached by the police at which our client ran from the basement area to an upper-level carpark where he was arrested.

Upon arrest, the police located several mobile phones and a bag containing fireworks.

During the search warrant the Police located in the bedroom of our client a replica Sniper rifle with a bolt action which is listed as a prohibited weapon. Police also alleged to have located strips of Buprenorphine, vials of Steroid substances and a substance police believed to be GHB/GBL.

Our client was conveyed to Belmont Police Station where he was entered into police custody and refused Bail.

Our client was charged with the following:

Possess unauthorised prohibited firearm under section 7(1) of the Firearms Act 1996

This offence carries a maximum penalty of imprisonment for 14 years.

Not Keep firearm safely prohibited firearm under section 39(1)(A) of the Firearms Act 1996

This offence carries a maximum penalty of imprisonment for 2 years and a fine of $5,500.

Possess prohibited drug under section 10(1) of the Drugs Misuse and Trafficking Act 1985

This offence carries a maximum penalty of imprisonment for 2 years and a fine of $2,200.

Possess prohibited drug under section 10(1) of the Drugs Misuse and Trafficking Act 1985

This offence carries a maximum penalty of imprisonment for 2 years and a fine of $2,200.

While in police custody our client contacted and retained Principal Solicitor and Accredited Criminal Law Specialist Mr Zemarai Khatiz from Oxford Lawyers.

On behalf of our client, Mr Khatiz applied for Bail and appeared at Belmont Local Court where Mr Khatiz made strong submissions that mitigated the bail risks that concerned the Magistrate.  As a result, our client was granted bail!
