Our client returned home late at night and an argument ensued between he and his wife.
The fight escalated where our client is alleged to have physically assaulted his wife. At this stage, our client’s wife rang ‘000’.
Police attended soon afterwards and witnessed our client in the process of driving away from the address.
Police have stopped our client and arrested him. Our client made admissions to police about assaulting his wife during the argument.
Our client was conveyed to Liverpool Police Station where he was charged with:
Common Assault, Domestic Violence related under Section 61 of the Crimes Act 1900.
The maximum penalty for this offence is 2 years imprisonment with a fine of $5500.
Police also imposed an Apprehended Violence Order (AVO) upon our client with conditions to restrict his contact with his wife and children.
A breach of this AVO entails a maximum penalty of 2 years imprisonment and a fine of $5500.
Our client retained Principal Solicitor and Accredited Criminal Law Specialist Mr Zemarai Khatiz.
Mr Khatiz appeared at Liverpool Local Court and made strong submissions on behalf of our client.
The Magistrate was convinced by Mr Khatiz and ordered for the Court to not record a conviction and to dismiss the charges pursuant to Section 10(1)(a).
This was a great result for our client, who was grateful for the dedicated efforts of Mr Khatiz and the Oxford Lawyers Team.
