Mid-range Drink Driving– No Conviction

During the Christmas period, whilst double demerits were in force, our client was pulled over for a RBT along the Great Western Highway in Wentworthville.

He was on his way home from a gathering held for a friend visiting from overseas. During the course of the night he had drank four beers, two whiskeys and a small bottle of Hennessy. At the end of the night he was feeling ok to drive.

His RBT however returned a positive reading of 0.148 which is almost three times the legal limit for a full licenced driver. Consequently our client was arrested and taken to Merrylands Police Station where he was subject to further breath analysis, returning another positive reading of 0.116.

Our client, as a first time offender, was charged with mid-range PCA under section 110(4) (a) of the Road Transport Act 2013 (NSW). This charge imposes a maximum penalty of 9 months imprisonment and a $2200 fine for first offenders, along with an automatic 12 month licence disqualification.

Our client feared the consequences of conviction. He needed to travel for work and was also the sole provider for his two children and wife. His wife had a Learner Licence and his conviction would have made life very difficult for the family’s day to day needs.
