Good Behaviour Bond for Client - Collision with Vehicle while on Drugs

Our client was driving and lost control of the vehicle, drove across double unbroken lines onto the wrong side of the road and collided with another vehicle which rotated 360 degrees and then smashed into a power pole.

Police attended the scene where they issued our client with several warnings to exit the vehicle; however our client was struggling to respond to these directions. Police helped our client from the vehicle and conducted a road side breath test which returned a negative result.

Police then formed the assumption that our client was driving under the influence of drugs because she was slurring her words, unsteady on her feet, appeared to have blood shot eyes and enlarged pupils. After they formed this suspicion, they conducted a road- side sobriety test that came back negative. Police arrested our client for the purpose of obtaining blood and urine samples from our client. These samples returned a positive result, where our client’s blood contained cannabis and GHB.

Our client was charged with driving a vehicle while under the influence of drugs under Section 112 (1) (a) of the Road Transport Act 2013.

The Maximum Penalty for this Offence is 18 months imprisonment and a fine of $3,300.

Understandably, our client’s distress over a possible jail sentence whilst being the primary carer for her 13-month old son compelled her to contact Oxford Lawyers. The Magistrate was persuaded and only imposed a good behaviour bond and significantly reduced the fine to $900.
