The Complainant and our client were in a domestic relationship. The complainant and our client have a child together.
Police alleged that our client did not allow the complainant to leave the residence with their child. It was alleged that our client was standing in front of the door, pushing and punching the complainant.
Our client then began to throw items around the home. The complainant attempted to restrain our client. During the struggle, our client punched, pushed and bit the complainant. As a result, the complainant is said to have suffered injuries and bruises.
Shortly After, the Police arrested our client and conveyed them to Newtown Police Station.
Our client was charged with Assault occasioning Actual Bodily Harm (domestic violence related) contrary to Section 59(1) of the Crimes Act 1900.
The maximum penalty for this offence is 5 years imprisonment.

Under the section 14 Mental Health Act, the application is for the Court to make an order for the criminal charges to be dismissed without a conviction or finding of guilt on the condition that the client complies with a mental health treatment or support plan.
Mr Zakaria made strong submissions that persuaded the Magistrate to grant the Application and the matter was finalised.
Our client was thrilled with the result, as no conviction or finding of guilt was recorded and they were able to continue treatment to address their mental health condition.
