Patrolling police officers took notice of our client due to his erratic driving which involved suddenly slowing down then speeding up and failing to indicate. Despite police activating their sirens in an attempt to pull him over, our client continued to drive his vehicle for several blocks before coming to a stop. Police performed a roadside breath test which returned a positive result on several attempts. Police subsequently arrested our client and escorted him to Fairfield Police Station. There he was subject to further breath analysis which returned a reading of 0.128 grams of alcohol in 210 litres of breath.
Our client was charged with drive with middle range prescribed concentration of alcohol under section 110(4)(a) of the Road Transport Act 2013. This offence typically carries a fine and a licence disqualification period. It also carries a maximum penalty of 9 months imprisonment.
Our client was distressed by this situation as it was his first offence.
