Client found Not Guilty after Domestic Dispute Turns Physical

Our client was a prospective police officer but an allegation of domestic violence could have ruined him forever.

Our client and his girlfriend got into a minor domestic dispute over comments left by her on Instagram. Things became heated and she began yelling at him to leave while pushing him and even throwing a clothing basket at his head in anger.

In an attempt to defend himself, he pushed her away. Unfortunately, the victim fell down and hurt her back. Our client immediately began apologising. In the days to come, our client and the victim exchanged text messages in which our client constantly apologised.

Nevertheless, a month later the victim went to the police and filed a report. Our client was arrested and charged with Assault Occasioning Actual Bodily Harm and Common Assault Domestic Violence related pursuant to s59 (1) and s61 of the Crimes Act 1900 NSW respectively. If found guilty of either of these offences, our client was facing a term of imprisonment.
