Our client live streamed a video which depicted our client holding a rifle.
In the video our client points the firearm directly at the camera and threatens to shoot people.
Police believed that our client was speaking to particular people viewing the footage.
The video was reported and sent to police. Our client made admissions to possessing the firearm during the video.
Our client was conveyed to Campbelltown Police Station.
Our client was arrested and charged with the following:
- Possess unauthorised firearm under Section 7a(1) of the Firearms Act 1996.
The maximum penalty for this offence is 5 years imprisonment.
- Not keep firearm safely not prohibited firearm/pistol under Section 39(1)(A) of the Firearms Act 1996.
The maximum penalty for this offence is 12 months imprisonment and a fine of $2200.
- Use Carriage Service to Threaten Serious Harm under Section 474.15(2) of the Criminal Code Act 1995.
The maximum penalty for this offence is 7 years imprisonment.
Considering the serious nature of the offences charged against our client, it was very possible the Court could have imposed a lengthy jail sentence against our client.
