Mr Zemarai Khatiz recently represented a client charged with possessing a prohibited drug and successfully secured the dismissal of the charge after challenging the admissibility of crucial prosecution evidence.
The Defence argued that the evidence should be excluded as it was in admissible. The Judge agreed and accordingly the charge was dismissed.
The Local Court upheld this challenge and ruled the evidence as inadmissible. As a result, the prosecution was unable to rely on key evidence supporting the charge and it was consequently dismissed.
