NOT GUILTY – Client Charged with Common Assault

Our client and the alleged complainant were housemates.

Our client confronted the alleged complainant about a household dispute.

The two were sitting in close proximity to one another at a small coffee table.

The alleged complainant became upset and out of frustration pushed a pot of water off the table.

Our client then retaliated by lunging towards the alleged complainant and punched him in the head.

The alleged complainant and our client were separated from one another and police were called.

Shortly after, police attended the location and spoke with the alleged complainant.

Our client made admissions to punching the alleged complainant and stated that the pot of water hit our client and caused him significant pain.

Police charged our client with Common Assault under Section 61 of the Crimes Act 1900.

The maximum penalty for this offence is 2 years imprisonment and a fine of $5500.
