Our client and the alleged complainant were housemates.
Our client confronted the alleged complainant about a household dispute.
The two were sitting in close proximity to one another at a small coffee table.
The alleged complainant became upset and out of frustration pushed a pot of water off the table.
Our client then retaliated by lunging towards the alleged complainant and punched him in the head.
The alleged complainant and our client were separated from one another and police were called.
Shortly after, police attended the location and spoke with the alleged complainant.
Our client made admissions to punching the alleged complainant and stated that the pot of water hit our client and caused him significant pain.
Police charged our client with Common Assault under Section 61 of the Crimes Act 1900.
The maximum penalty for this offence is 2 years imprisonment and a fine of $5500.
Anxious about the possible penalty for this offence our client contacted Oxford Lawyers and retained Principal Solicitor and Accredited Criminal Law Specialist Mr Zemarai Khatiz.
Mr Khatiz believed in our client’s version of events and appeared for him at Downing Centre Local Court for a Defended Hearing.
Thanks to Mr Khatiz’s strong knowledge of the law and his dedication to his client, the Magistrate ruled in our clients favour and held he was Not Guilty of this charge.
Our client couldn’t have been happier with the result as it meant he could put this incident behind him and he was able to move on to better things in life.
