Our Client was shopping in the city CBD and entered the Gucci store, where he made a purchase. Unfortunately, our client forgot to pay for a belt which he was holding in his hand valued at $700. The Gucci store reviewed CCTV footage and reported the matter to the police.
After a police investigation, our client was charged with shoplifting pursuant to section 117 of the Crimes Act 1900. Prior to this charge, our client had never been in any trouble before the courts.
Our client had honestly forgotten to pay for the belt and did not have the intention to permanently deprive the store. Our client sought to defend this charge and wisely contacted Mr Zemarai Khatiz, Principal Defence Solicitor and Accredited Criminal law specialist. The matter proceeded to a defended Hearing at Downing Centre Local Court. Mr Khatiz persuaded the court that there was insufficient evidence for the prosecution to prove their case beyond reasonable doubt and the client did not have the intention to permanently deprive the store of the belt. The magistrate accepted these submissions, finding our client not guilty of the offence.
Our client was extremely pleased to avoid a conviction which would have tarnished his good character.
