Client Not Guilty at Trial for Armed Robbery and Kidnapping !

The Victims were at their home having lunch. During this time several men entered the house. The men were unknown to the occupants of the house. It was alleged that one of the perpetrators were armed with a knife with a 15 cm blade, another armed with what the victim believed to be a black hand gun; another with a taser and machete. The victims recall there being anywhere between 5-7 perpetrators in their home, all disguised with black face masks and gloves. It was alleged by the Crown that our client, was one of the alleged perpetrators. The males then assaulted and handcuffed the victims.

While handcuffed, the males then rummaged through the property and stole over $30,000. The group left the property within a matter of minutes. Police alleged that our client was involved having located his finger print on the getaway away and his DNA on a black face mask (matching the description given by the victims) in a domestic garbage bin located some 200 meters from where the home invasion occurred.

Following the forensic findings, our client was arrested and charged with :

armed with a dangerous weapon in company contrary to Section 97(2) of the Crimes Act 1900.
The Maximum Penalty for this offence is 25 years imprisonment.
Kidnapping contrary to Section 97(2) of the Crimes Act 1900.
