Client Charged with supply of prohibited drugs, receives no jail time

A young man attended a music festival ‘Field Day’ and carried some drugs with him to give to friends. Police within that area noticed our client and detained him for the purposes of search. During the search he attempted to attempted to run away but was retrained by the police. He then tried to swallow a bag full of MDMA capsules. The police then discovered 29 capsules of MDMA in our client’s possession. Our client’s belongings was searched where police located an iPhone, in which contained messages relating to supply of prohibited drugs such as “Can I buy off you tomorrow?”

Our client was arrested and taken to Surry Hills Police Station. He was charged with Supply a prohibited Drug under section 25(1) of the Drug Misuse and Trafficking Act 1985. He was also charged with Resist officer in execution of duty under section 58 of the Crimes Act 1900 Section. Due to serious nature of the offences, our client was faced with the prospect of a significant term of imprisonment.

Desperately wanting to avoid jail, he wisely retained Principal Solicitor and Accredited Criminal Law Specialist Mr Zemarai Khatiz and had the Oxford Lawyers team on the case. Mr Khatiz presented convincing submissions to the Downing Centre Local Court and brought to the attention of the magistrate to a number of relevant factors. The Court was persuaded by the submissions which led to our client being able to walk away with only a good behaviour bond.

Our client was very pleased with the result as it meant that he was able to avoid jail time. He would be able to return to his everyday life and continue to work and play football within the community.
