Client Charged with Affray, Received No Conviction

Our client, a university student, was taking a much needed break and went out one Saturday night with his friends. As the night progressed, he got into an altercation with another male on the premises and both individuals were asked to leave. As he was leaving the premises he ran into the same male. The male’s friend yelled out “one v one” and another physical altercation ensued whereby a number of punches were exchanged. Our client sustained a small cut to his head before security tackled the other male to the ground and ended the fight.

Our client was taken down to Castle Hill Police Station and charged with affray under section 93C (1) of the Crimes Act 1900. This charge carries a maximum sentence of 10 years.

Our client feared the consequences of conviction as he was undergoing his undergraduate studies in construction management and had future aspirations of joining the legal industry.

A conviction would be detrimental to his future prospects of employment and he knew it was within his best interest to seek legal advice. Ms Rashidi appeared on behalf of our client at Parramatta Local Court and highlighted that this conduct was completely out of character. Upon her compelling submissions the Court agreed to issue a good behaviour bond with no conviction.
