A young woman attended a music festival with friends who got convinced to carry some drugs. A sniffer dog picks up the smell upon entry and the Police search our client and found 10 MDMA capsules on her.
Our client was charged with possession of MDMA at the FOMO Music Festival in Parramatta. Our client attempted to attend the festival and was persuaded by her friends to carry some drugs upon entry and redistribute them back to her friends. The police had sniffer dogs at the entry gates and as fate would have it, the sniffer dogs detected the scent of illicit substances. Our client was subsequently strip searched and 10 pills of MDMA was located on her.
Our client was charge
d with possession of drugs under section 10(1) of the Drug Misuse & Trafficking act 1985 which carries a maximum sentence of two years imprisonment and a fine of $2200.
The client retained Mr Zemarai Khatiz, Principal of Oxford Lawyers and Accredited Specialist in Criminal Law to help. Mr Khatiz presented strong submissions and urged the Court to consider a combination of relevant factors as to why our client should not have a conviction recorded. The court agreed with Mr Khatiz and no conviction was recorded by virtue of a section 10.
