Our client was driving his vehicle when he was stopped by police and was submitted to a random breath test which returned a positive result. our client was placed under arrest for the purpose of breath analysis.
During the arrest police formed reasonable suspicion that our client may have in his possession prohibited drugs and conducted a search of himself and his vehicle.
Our client was then conveyed to Granville Police Station where he was submitted to a breath analysis, returning a negative result. Our client was then submitted to an oral fluid test which returned a positive result to Cocaine and Methyl-Amphetamine.
Our client was then read a form of demand for a secondary oral fluid test and he refused to provide the necessary saliva sample for the analysis.
Our client was arrested and charged with the following in relation to this matter:
Refuse or Fail to provide oral fluid sample under Schedule 3 Clause 17(1)(b) of the Road Transport Act 2013.
The Maximum penalty for this offence is a fine of $3300 and a licence disqualification period of 3 years.
Upon a Conviction, the minimum licence disqualification period is 6 months.
At this time, our client had not retained Oxford Lawyers services and he was convicted in his absence. Our client received a fine and a licence disqualification of 3 years.

A section 4 Annulment is an application for the annulment of a conviction imposed by the Local Court whereby the defendant was not in the appearance of the Local Court when the Conviction was imposed.
Mr Khatiz Attended Parramatta Local Court and made submissions on behalf of our client regarding his absence and in relation to reducing the severity of the punishment imposed upon our client.
The Magistrate was persuaded by Mr Khatiz’s submissions and reduced the licence disqualification from 3 years to the minimum amount possible – 6 months.
